Error Code F1040-041: If Form 1040, Line 39b checkbox 'MustItemizeInd' is checked, then Line 3 checkbox "Married filing separately" must be checked (element 'IndividualReturnFilingStatusCd' must be equal to 3).

Form 1040, line 39b will be marked for two different reasons:

If this is a married filing separate return that is being forced to itemize, verify the data entry on the following fields on Screen 1040, located under the General folder: Filing Status Code is equal to 3, Married filing separate and Standard/itemized deduction (Force) is equal to 2, Itemized.

If the Form 1040, line 39b checkbox is marked because it is a dual status return, the return must be filed on paper; The IRS does not accept Form 1040 with a Form 1040NR statement attached to the return as a PDF file through the Modernized e-File (MeF) program.
