Why is Form 8962 using the prior-year federal poverty line?

Answer

Section 1.36B-1(h) provides that the calculation of the Premium Tax Credit uses the federal poverty line most recently published as of the first day of the open enrollment period of a calendar year. Since the first day of open enrollment is generally October 1 of the year before the coverage year, the most recently published federal poverty line is for the year before the coverage year. For the purposes of calculating Form 8962, the federal poverty line will always be one year behind the tax year.
