New for 2018
- Surtax: Corporate taxpayers, except for public utilities, with allocated net income in excess of $1 million for New Jersey tax years 2018 and 2019 will be charged a surtax of 2.5%. Such taxpayers with allocated income in excess of $1 million in New Jersey tax years 2020 and 2021 will be charged a surtax of 1.5%
- Sourcing: For tax years beginning after 2018, sales of services will no longer be sourced based upon where the services are performed. Instead, they are based on where the benefit of the service is received.
- Dividend exclusion: For tax years beginning after December 31, 2016, the 100% dividend exclusion for dividends received from subsidiaries owned 80% or more is reduced to a 95% exclusion. Filers subject to this reduction for New Jersey tax year 2017 are required to file Form CBT-DIV 2017 on paper, after having filed their original return. Filers subject to this reduction for New Jersey tax year 2018 will include any necessary adjustments directly on Form CBT-100 when filed.
- The following provisions will become effective for tax years beginning after 2018:
- Combined reporting: For tax years that begin after 2018, New Jersey will permit and require combined reporting.
- Deferred Tax Deduction: For tax years that begin after 2018, If combined reporting provisions result in an aggregate increase to a net deferred tax liability or decreases a net deferred tax asset, the group may be entitled to a deduction.
